The Myth That Expert Witnesses Just Say What They Are Paid to Say

Where the “Hired Gun” Idea Comes From

Most people have seen a courtroom drama where an expert witness takes the stand and says exactly what the lawyer who hired them needs to hear. The lawyer nods. The jury looks convinced. The other side’s expert says the opposite, word for word.

That scene sticks because it is simple and a little cynical. It also misses almost everything about how expert testimony actually works in a real case. Experts are not props. They are bound by rules, and those rules exist because courts worried about this exact problem long before television writers did.

    What the Rules Actually Require

Expert witnesses do not just offer opinions. They have to show their work. In federal court, and in most state courts that follow similar rules, an expert has to explain the method behind an opinion, not just the conclusion.

That means an expert on, say, computer memory technology or a damages calculation has to walk through the data, the assumptions, and the steps that got them to a number. If the method is sloppy or built backward from a desired answer, the other side’s lawyers will find it. Cross-examination exists to expose exactly that kind of shortcut.

    How Courts Screen Expert Testimony

Before a jury even hears an expert, a judge often has to decide whether the testimony is allowed at all. This happens through pretrial hearings where each side can challenge the other’s expert.

A judge can exclude testimony if the method behind it is not reliable, even if the expert is well credentialed and confident. This screening step is one reason the “says whatever they’re paid to say” idea does not hold up. An expert whose opinion is just an advocate’s talking point dressed up in a resume rarely survives this stage.

What a Credible Expert Witness Actually Does

A good expert witness is not picked because they will say something favorable. They are picked because they can explain a real, defensible opinion clearly enough for a jury of non-specialists to follow it, and because that opinion can hold up under hostile questioning.

Jason Sheasby, a partner at Irell & Manella LLP, is a trial attorney who has worked on complex technology and patent cases where expert testimony on damages and technical issues plays a central role. In that kind of litigation, the expert’s job is to make a complicated subject understandable without oversimplifying it into something misleading. That is a harder balance than the “hired gun” stereotype suggests.

Signs an Expert Witness Is Doing It Right

A few patterns separate a credible expert from a weak one:

    • They acknowledge limits. A credible expert admits what their analysis does not cover instead of claiming certainty on everything.
    • Their method is consistent. The same approach should produce similar conclusions if applied in other similar cases, not just this one.
    • They can explain it simply. If an expert cannot describe their opinion in plain language, a jury will not trust it, no matter how technical it sounds.
    • They survive cross-examination without changing their story. Pressure reveals whether an opinion is built on solid ground or just confidence.

    Why This Myth Persists

Part of the reason the hired gun idea sticks is that each side does choose its own expert, and that expert is paid for their time. That part is true and it is not hidden from anyone. Jurors are told who retained the witness and how much they are being paid.

But being retained by one side is not the same as being untrustworthy. A structural engineer hired to evaluate a building collapse, or an economist hired to calculate lost profits, still has to answer to the same rules of evidence and the same cross-examination as any other witness. The system assumes bias is possible and builds in ways to test for it, rather than pretending it does not exist.

What This Means for Anyone Watching a Trial

If you are following a case, whether as a juror, a reporter, or just someone curious about how trials work, it helps to watch for the things that actually separate strong expert testimony from weak testimony. Pay attention to whether the expert explains their method, whether they hold up under tough questions, and whether their opinion matches the data they are relying on. That tells you far more than who is paying their fee.
